Kico Terms of Service

These Terms of Service ("Terms") govern your access to and use of Kico, including its fitness-focused course content, workout sharing features, voice rooms, posts, comments, messaging features, and related services (collectively, the "Service"). By accessing or using Kico, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You may use Kico only if you are legally permitted to enter into these Terms. You must be at least 13 years old, or the minimum age required to use online services in your jurisdiction if that age is higher. If you are under the age of legal majority where you live, you may use Kico only with the permission of a parent or legal guardian where required by law.

You may not use Kico if applicable law prohibits you from receiving or using the Service.

2. Account Registration and Security

Some features may require an account. You agree to provide accurate information, keep your account information reasonably current, and protect your login credentials. You are responsible for activity carried out through your account unless prohibited by applicable law.

You must not impersonate another person, create an account using information you are not authorized to use, or attempt to gain unauthorized access to another account.

3. Nature of the Service

Kico is designed around everyday fitness participation and sharing. Features may include:

• fitness-related course notes and learning materials;
• home workout, gym routine, stretching, bodyweight, strength, cardio, warm-up, and training-method topics;
• workout posts, progress clips, gym photos, exercise records, and routine notes;
• live or real-time voice rooms focused on fitness topics;
• comments, discussions, messaging, and other community interactions;
• reporting, blocking, moderation, and other safety tools.

We may add, modify, limit, suspend, or discontinue features when reasonably necessary for product, security, legal, technical, or operational reasons.

4. No Medical, Health, or Professional Fitness Advice

Kico content may describe personal routines, exercise habits, training experiences, or general fitness ideas. Such content is not a substitute for advice from a physician, licensed healthcare provider, certified trainer, physical therapist, dietitian, or other qualified professional.

You are responsible for deciding whether any exercise, routine, or activity is appropriate for you. Stop exercising and seek appropriate professional assistance if you experience pain, dizziness, fainting, breathing difficulty, injury, or other concerning symptoms. If you have a medical condition, injury, pregnancy, disability, medication-related concern, or other health issue that may affect exercise, consult an appropriate professional before participating in physical activity.

Kico does not guarantee that any user-submitted routine, course note, exercise suggestion, progress method, or training discussion is accurate, complete, safe, suitable, or effective.

5. User Content

"User Content" means content you submit, upload, publish, transmit, or otherwise make available through Kico, including text, photos, videos, voice-room contributions, comments, messages, exercise records, workout notes, profile information, and similar materials.

You retain ownership of rights you have in your User Content. By making User Content available through Kico, you grant Kico a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to host, store, reproduce, process, adapt for technical formatting, display, transmit, and distribute that User Content solely as reasonably necessary to operate, secure, improve, and provide the Service, subject to applicable law and your privacy settings.

This license ends when your User Content is deleted from our systems, except to the extent retention is reasonably necessary for backups, legal obligations, safety, fraud prevention, dispute resolution, enforcement, or content previously shared with others in a manner that cannot reasonably be withdrawn.

6. Your Responsibilities for User Content

You are responsible for User Content you provide. You represent that you have the rights and permissions necessary to make it available through Kico and that your content does not violate law, these Terms, or the rights of others.

Do not upload or share content that:

• infringes copyrights, trademarks, privacy rights, publicity rights, or other rights;
• contains unlawful threats, harassment, abuse, hate-based attacks, or targeted intimidation;
• contains sexual exploitation, child sexual abuse material, or unlawful sexual content;
• promotes self-harm, dangerous challenges, or reckless exercise behavior likely to cause serious injury;
• presents medical diagnosis, treatment, or professional health advice in a misleading or deceptive way;
• promotes illegal drugs, doping substances, unlawful performance-enhancing substances, or illegal activity;
• contains malware, malicious code, phishing, fraud, spam, or deceptive schemes;
• reveals another person's sensitive or private information without authorization;
• is otherwise unlawful or creates a serious safety or security risk.

7. Voice Rooms and Real-Time Interactions

Voice rooms are intended for fitness-related discussion, including workouts, routines, course details, exercise habits, equipment, and everyday training experiences. You must treat other participants respectfully and comply with applicable community and safety rules.

Real-time interactions may involve people with different experience levels. Statements made by room hosts or participants are their own and are not endorsed or verified by Kico merely because they appear in the Service.

You may not use voice rooms to harass others, coordinate harmful conduct, distribute unlawful content, solicit illegal activity, or falsely present yourself as a medical or other licensed professional.

8. Community Safety, Reporting, and Blocking

Kico may provide tools that allow users to report content or conduct and block other accounts. We may review reports and take action when we reasonably believe content or activity violates these Terms, our community rules, law, or safety requirements.

Possible actions may include limiting visibility, removing content, restricting features, muting or removing participants from voice rooms, warning users, suspending accounts, terminating accounts, preserving evidence, or reporting matters to appropriate authorities where required or permitted by law.

We do not guarantee that all objectionable content will be identified or removed immediately.

9. Prohibited Conduct

You may not:

• use Kico for unlawful, fraudulent, deceptive, or harmful purposes;
• interfere with or disrupt the Service, servers, networks, or security systems;
• scrape, crawl, harvest, copy, or extract data from Kico through unauthorized automated means;
• attempt to reverse engineer, bypass, disable, or defeat access controls or security measures except where applicable law expressly permits it;
• use another person's account without authorization;
• send spam, mass solicitations, or repetitive unwanted messages;
• use Kico to stalk, threaten, exploit, or harass another person;
• misrepresent professional qualifications or make deceptive claims about health, medical treatment, or fitness outcomes;
• encourage dangerous training practices that create a foreseeable risk of serious harm;
• circumvent moderation, account restrictions, or enforcement actions.

10. Intellectual Property

Except for User Content, the Service and its software, design, branding, text, graphics, interfaces, features, and other materials are owned by or licensed to Kico and are protected by applicable intellectual property laws.

These Terms give you a limited, personal, non-exclusive, non-transferable, revocable right to use the Service for its intended purpose. No other rights are granted except as expressly stated.

11. Feedback

If you voluntarily submit ideas, suggestions, or feedback about Kico, you authorize us to use that feedback without restriction or compensation, to the extent permitted by law. This does not transfer ownership of your unrelated User Content.

12. Third-Party Services

Kico may rely on or link to third-party services, software, websites, or infrastructure. Third-party services are governed by their own terms and privacy practices. Kico is not responsible for third-party services that we do not control.

13. Suspension and Termination

You may stop using Kico at any time. Where account deletion functionality is available, you may request deletion through the Service or by contacting us.

We may restrict, suspend, or terminate access if we reasonably believe you have materially or repeatedly violated these Terms, created a safety or security risk, exposed Kico or others to legal liability, or if restriction is reasonably necessary to comply with law. Where appropriate and legally required, we may provide notice or an opportunity to appeal.

14. Disclaimers

To the maximum extent permitted by applicable law, the Service is provided on an "as is" and "as available" basis. Kico does not guarantee uninterrupted availability, error-free operation, accuracy of user-submitted content, specific fitness results, or that the Service will meet every user's expectations.

Kico is not responsible for injuries, losses, or damages caused by a user's decision to follow exercises, routines, training plans, or advice shared by other users, except to the extent such liability cannot legally be excluded.

15. Limitation of Liability

To the maximum extent permitted by applicable law, Kico and its operators, affiliates, officers, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, goodwill, or other intangible losses arising from or related to your use of the Service.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including rights you may have under mandatory consumer protection laws.

16. Indemnity

To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Kico and its operators from claims, liabilities, damages, losses, and reasonable costs arising from your unlawful use of the Service, your material breach of these Terms, or User Content that violates another person's rights. This section does not apply where prohibited by applicable consumer law.

17. Changes to These Terms

We may update these Terms to reflect changes in the Service, legal requirements, safety practices, or business operations. If changes are material, we will provide notice in a manner appropriate to the circumstances where required by law. The updated Terms will state a new effective date.

18. Governing Rules and Disputes

These Terms are governed by applicable laws and mandatory consumer protections that apply to your relationship with Kico. Nothing in these Terms removes rights that cannot be waived under the law of your place of residence.

If a dispute arises, please contact us first so we can attempt to resolve the matter informally. You may also have the right to bring a claim before a competent court or consumer protection authority under applicable law.

19. Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will remain in effect to the extent permitted by law.
